After spending 18 months in prison — 7 in solitary confinement – New York City police officer Gilberto “Cannibal Cop” Valle has been released from jail. Judge Paul G. Gardephe of the Federal District Court in Manhattan overturned Valle’s 2013 “kidnapping conspiracy” conviction this week, stating that there was no sufficient evidence the prove that Valle was actually planning on abducting, raping, torturing, cooking (oil-basting, slow-live-roasting, etc) and eating 100 women. He was only fantasizing about in an elaborate details with fellow users of the fetish porn website Dark Fetish Net (NSFW).
The judge called Valle’s communications “deeply disturbing” and “misogynistic” as well as ”deviant and depraved” but not enough to prove he was going to go through with his schemes. In a 140-page opinion (embedded bellow), the judge detailed that Valle’s alleged co-conspirators were located in New Jersey, India or Pakistan and in England, with no plans to talk on the phone or meet in person.
The presence and quantity of concededly fictitious and fantastical elements in the chats and emails that the Government claims are “real” precludes any reasonable inference that Valle actually intended to kidnap a woman.
The fantastical elements are Valle’s descriptions of a human-size rotisserie and “pulley-apparatus” he would use to cook women in. The judge adds that Valle is “an individual obsessed with imagining women he knows suffering horrific sex-related pain, terror and degradation.”
Valle’s second conviction stands, as he illegally, improperly used the National Crime Information Center database to illegally looking up potential victims/fantasy subjects. The conviction carried a maximum sentence of one year. (Image: @LisaEvers)
